Wherever possible, we aim for an amicable solution. Where necessary, we represent your interests firmly – out of court and before the family court.

Areas of Expertise

How we cansupport you.

01

Divorce

A marriage can generally be dissolved once it has broken down – as a rule after the one-year separation period. Only a lawyer can file the divorce petition with the family court. We guide you through the entire process: from advice on separation and filing the petition to the hearing before the family court. We also keep an eye on the consequences of divorce – pension rights adjustment, equalisation of accrued gains, maintenance, and the marital home and household items. An amicable divorce saves time, costs and stress; where agreement is not possible, we enforce your rights firmly.

  • Amicable & contested divorce
  • Pension adjustment & equalisation of gains
  • Separation & post-marital maintenance
  • Divorce settlement agreements

Marriage Contract

A marriage contract creates clarity – before the wedding or during the marriage. It allows the statutory rules on the matrimonial property regime, maintenance and pension rights adjustment to be adapted to one's own circumstances, for example for entrepreneurs and the self-employed, where incomes or assets differ significantly, or in a second marriage. A marriage contract must be notarised and must not place either spouse at an unreasonable one-sided disadvantage – otherwise it may be wholly or partly invalid in the event of a dispute. We advise you on the options available, draft balanced provisions and review existing contracts.

  • Separation of property or modified community of gains
  • Provisions on maintenance & pension adjustment
  • Protection of businesses & business assets
  • Review of existing marriage contracts
  • Preparation for notarisation

Frequently Asked Questions

Family lawbriefly explained.

That depends above all on whether the spouses agree. An amicable divorce can often be completed within a few months after the separation year has ended. If ancillary matters such as maintenance or the equalisation of gains are disputed, proceedings can take considerably longer. We give you a realistic assessment at an early stage.

Only a lawyer can file the divorce petition. In an amicable divorce it is usually sufficient for only one spouse to be legally represented – the other can consent to the divorce without their own lawyer. Important: a lawyer may only ever represent the interests of one spouse. As soon as contentious issues need to be resolved, separate legal advice is therefore advisable for both sides.

Yes. A marriage contract can be concluded or amended before the wedding and at any time during the marriage. In every case it must be notarised. We prepare the provisions together with you so that the notary appointment runs smoothly and without surprises.
